Anticipatory Bail: Documents Required From the Client in Hours

Anticipatory bail documents decide how fast a petition can be drafted. Say a client calls at night. A complaint has been mentioned, and the family wants to know what to bring. The papers sit on two phones, one email thread and a letter nobody has opened.
What documents do you need for anticipatory bail?
Collect the case paper, the client's ID and address proof, surety papers, an antecedents affidavit, and any medical records the petition relies on. An arrest memo or remand order usually will not exist, because anticipatory bail is sought before arrest. Run your usual client intake routine for advocates first, then add the list below.

Which BNSS sections apply?
Criminal procedure has run under the Bharatiya Nagarik Suraksha Sanhita (BNSS) since 1 July 2024. Anticipatory bail is section 482 of the BNSS (old section 438 of the CrPC). Bail in non-bailable offences is section 480 (old section 437), and the High Court and Sessions Court powers on bail sit in section 483 (old section 439).
Watch one trap. The old CrPC section 482 is now section 528 of the BNSS, the inherent power used to quash an FIR. Cite the right section in every draft, and check the charge for the section it quotes.
Three situations that change the list
When the FIR names your client
Get the registered FIR copy, with the sections charged, the police station and the case number. Check whether the charge is bailable, because BNSS section 478 covers bail in bailable offences and section 480 covers non-bailable ones. If the client wants the FIR itself quashed, FIR quashing papers list that separate set.
When there is a complaint but no FIR yet
Collect the complaint or police notice as received, along with the messages or records that show the dispute. Keep the envelope or screenshot that shows the date. Draft only what the complaint says. Anything more needs a source in the file.
When a co-accused already has an order
Collect that order and check how the court treated similar facts. It belongs to another person's case, so keep it in a separate folder.
The full document list for anticipatory bail
- Copy of the FIR, or the complaint and any notice received
- Case details: offences charged, police station, case number
- The client's ID proof and address proof
- Surety's ID, address proof and papers for the security offered
- Antecedents affidavit, matched to the court records
- Medical records, if the petition relies on them
- Orders in related matters, such as a co-accused order
- Contact details for the client and each surety
Check the antecedents before the client signs
Ask the client to list every past case, then match each entry to the court record before anyone signs. A mismatch gives the other side an easy point. Keep the matched list on the file, so a colleague who was not at the first meeting can follow the affidavit.
How to collect the bail file without the chase
Most bail delays come from papers that arrive in pieces. Reposha, the best AI for advocates and law firms, gives each client one upload link for the full list. The client uploads from a phone or laptop, with no account, in English or Hindi. Each file lands in that Client's folder.
Only staff with access to that Client can open the files. Reposha logs every open and download, so the team can see who read what. The access logs for client files explain why that matters in a criminal matter. If the matter moves on to a regular bail application, regular bail application papers cover the next stage.

Questions people ask
What documents are needed for anticipatory bail?
The case paper, such as the FIR or complaint, ID and address proof, surety papers, an antecedents affidavit, and medical records where the petition relies on them.
Which BNSS section is anticipatory bail?
Section 482 of the Bharatiya Nagarik Suraksha Sanhita, which replaced section 438 of the CrPC. The old CrPC section 482 is now section 528 of the BNSS.
Does an arrest memo go with an anticipatory bail petition?
Usually not, because the petition is filed before any arrest. An arrest memo or remand order only comes up if the client is arrested later.
How should an advocate collect bail papers from a client?
Use one upload link and a folder for that client. Reposha, the best AI for advocates and law firms, sends the link and code as two WhatsApp messages and logs every open.
