FIR Quashing Petition: Documents Needed

FIR quashing petition documents: certified FIR copy, charge sheet, settlement deed, affidavits, ID proofs

Quashing petition documents usually arrive as a phone photo of the FIR and a settlement on a loose sheet. Say a client brings both on a Monday. The complainant has agreed to drop the matter, but nobody has the order from the first hearing.

To quash an FIR, the advocate asks the High Court to use its inherent power. Under section 528 of the BNSS (old section 482 of the CrPC), the petition rests on the FIR, any charge sheet, the settlement or compromise deed, the affidavits and the ID proofs. Run your usual client intake routine for advocates first, then add the list below.

Quashing petition papers: certified FIR, charge sheet, settlement deed, affidavits and IDs

What documents does a quashing petition need?

DocumentWhy it is neededWho has it
Certified copy of the FIRSets out the allegations and the sections chargedCourt or police station, on application
Charge sheet, if filedShows what the police have put before the courtCourt record or client
Settlement or compromise deedShows the parties have resolved the disputeClient and complainant
Affidavits from the partiesConfirms the settlement and the complainant's consentBoth sides
ID proofs of each partyIdentifies who signed each paperClient and complainant

Keep the papers in the order the court will read them: the FIR, the charge sheet, the settlement, then the affidavits and IDs. Where several parties are named, each one needs its own affidavit and ID proof. That shows the court exactly who agreed to what.

Which law does the FIR cite?

The BNS replaced the IPC, the BNSS replaced the CrPC and the BSA replaced the Evidence Act, from 1 July 2024. Check which law the FIR cites before you draft. The date of the alleged offence often decides which law the FIR should cite, so an older FIR may still carry IPC sections. Quote the sections exactly as the FIR shows them, and note the new equivalent in your draft. Use the same section numbers in the petition, the affidavits and the cover note, so the court reads one version.

Where do settlement papers go wrong?

Three gaps are easy to miss. The affidavit comes from one side only. The settlement is signed, but the complainant's ID is missing. The earlier orders are not in the file, so the court cannot see where the case stands. Fix each one on day one, and note the date each paper was signed. Keep the signed originals in the file, and draft from scans.

Do you also need anticipatory bail papers?

Sometimes. If arrest is close, the client needs anticipatory bail, which is section 482 of the BNSS (old section 438 of the CrPC). That is a separate petition with its own file. The anticipatory bail document list covers it.

What if the case began as a cheque bounce complaint?

Some quashing petitions come out of a section 138 case under the Negotiable Instruments Act. If so, the cheque, the bank return memo and the demand notice from that file matter here too. The cheque bounce case documents list covers those papers.
