Defective Return Notice u/s 139(9): What to Ask the Client For

A 139(9) defective return notice needs a short list of documents, not the whole file. The clock is 15 days, and the usual mistake is to send everything. That wastes most of the window.
The short answer
A notice under section 139(9) of the Income-tax Act, 1961 flags a defective return. The taxpayer gets 15 days to respond, and the window can be extended on request. Ask the client only for the papers behind the defect the notice names.
For FY 2025-26 and earlier, the 1961 Act still governs this notice, through section 536(2)(c) of the Income-tax Act, 2025. For tax year 2026-27 onward, the equivalent provision under the 2025 Act is section 263(7).
If the return was built from a complete ITR document list, most of the source papers may already be on file. The notice tells you which ones are still missing.
Read the notice before you call the client
Every notice carries a Document Identification Number (DIN). Quote it in every reply, and keep a copy of the notice in the file. Notices are issued and answered on the e-filing portal, so check the portal for the notice before you set the calendar. Most assessments are faceless, which means the reply goes through the portal, not to a desk.
Read the defect list line by line. Each line is a question the department has asked. Your reply should answer each line, in the same order, so the reviewer can tick them off.
Mistakes that slow the fix
1. Treating it as a 143(1) adjustment. The two notices carry different windows. A 139(9) notice gives 15 days, and a proposed adjustment under 143(1)(a) gives 30. Note the section and the due date on day one. If the notice is an adjustment, use the 143(1) intimation reply guide instead.
2. Asking for the whole year. A full file request buries the one gap that matters. Ask for the defect the notice names, then check it against the return.
3. Sending a corrected figure with no source. A new number without its certificate or receipt gets questioned again. Pair every figure with the paper that proves it.
4. Skipping the missing attachments. If the notice points to a schedule or attachment, collect that item first. It is often the quickest fix in the file.
5. Leaving the extension to the last day. The window can be extended on request. Ask early, because a request made on the final day leaves no room if it is refused.
The documents to ask for, defect by defect
| Defect the notice names | Document to ask for | Who has it |
|---|---|---|
| Bank account details missing or wrong | Bank letter or passbook page with account number and IFSC | Client |
| Interest income missing from the return | Interest certificate for every account | Client's bank |
| Deduction claimed without proof | Receipts, premium statements or certificates | Client, or the institution |
| TDS claimed but not matching | TDS certificate from each deductor | Client, deductor |
| Missing schedule or attachment | The filing pack as submitted, plus the underlying papers | CA firm |
| Figures that do not tally | Working papers for the computation | CA firm |
Only the rows that match the notice apply. The rest can wait.
Collect the defect papers without the chase
The request is small, so the collection should be small too. Reposha, a WhatsApp alternative for client documents, sends one upload link per request. Each Client gets a folder, and every open and download is logged. The Client receives the link and a one-time access code as two separate WhatsApp messages, then uploads from a phone or laptop with no account. Reposha upload pages come in English and Hindi.
The routine behind collecting ITR papers without the chase works here too. Send the list once, with the reason attached, and track what has come back.
