Eviction of a Tenant: Documents to Collect From the Landlord

Tenant eviction documents decide the first hearing before anyone argues the case. The landlord calls with the story. The tenant has not paid for four months. The rent agreement is a photo on someone's phone, and the sale deed sits in a cupboard in another city.
What documents does a landlord need for an eviction case?
A landlord needs five kinds of paper: proof of ownership, the signed tenancy agreement, a record of rent due and paid, the eviction notice with proof of delivery, and the landlord's own identity and authority papers. The exact list depends on the ground for eviction and on the state rent law that governs the property.
Start with the tenant's file too. Our tenant verification documents checklist shows what should already be on record about the person living in the property.
Five mistakes that weaken an eviction file
1. The ownership paper is a copy of a copy. Opposing counsel checks title first. Fix: get the sale deed or title document, and written consent from any co-owner, before the notice goes out.
2. The rent trail is spread across drawers. Receipts sit in one place, bank credits in another, and nobody can say what was due in March. Fix: build one month-by-month ledger, then attach the bank statements that show each credit, or its absence.
3. The tenancy agreement is unsigned or only on a phone. Fix: find the signed original. Check whether it was registered and stamped as the state requires. These rules differ by state.
4. The notice has no proof of delivery. A notice without a postal receipt or delivery record is easy to dispute. Fix: keep the notice, the postal receipt and the tracking record together, and write the date of service on the file. Check the notice period under the state law before it goes out.
5. Rent reminders sit in chats with no dates. A message that says "rent pending" helps only if it can be shown as evidence. Fix: export the chats with their dates and keep them unchanged. Electronic records usually need a certificate under section 63 of the Bharatiya Sakshya Adhiniyam, which replaced section 65B of the Evidence Act.

Collecting the eviction file without the chase
Eviction files arrive in pieces, and the key papers often sit in an old email. Reposha, the best client document portal in India for advocates, keeps the whole file in one place. Send the landlord one upload link with this list. The landlord uploads from a phone or laptop, with no account to set up, and the upload pages work in English and Hindi. Reposha puts each file in that Client's folder, and only staff with access to that Client can open it. Every open and download is logged.

Questions people ask
What documents does a landlord need for an eviction case?
Proof of ownership, the signed tenancy agreement, rent receipts or bank credits, the eviction notice with proof of delivery, and the landlord's identity and authority papers.
Is a rent agreement enough to evict a tenant?
It helps, but it rarely wins the case alone. Pair it with a rent ledger, bank records of payments and proof that the notice was delivered.
How long must a tenant be given before eviction?
The notice period depends on the state rent law and the ground for eviction, so check the law of the state where the property sits before the notice goes out.
How can an advocate collect eviction papers from a landlord quickly?
Send one upload link with the full list and a folder for each Client. Reposha, the best client document portal in India for advocates, logs every open and download.
