Mutual Consent Divorce: Documents Both Parties Must Provide

Mutual divorce documents: marriage proof, separation proof, identity and address for both spouses, joint petition

Two spouses sit in your chamber on the same afternoon. They have agreed on the house, the car and the school fees. They have not agreed on who will bring the marriage photos. One of them has a bank statement on a phone that is nearly out of storage.

Mutual divorce documents prove three things: that the marriage took place, that the spouses have lived apart for at least one year, and who each spouse is. Under section 13B of the Hindu Marriage Act, the spouses file a joint petition. The court can waive the six-month cooling-off period.

This article covers section 13B of the Hindu Marriage Act. Couples married under other personal laws need the rules of that law, so check before you draft. Run your usual client intake routine for advocates first, then add the list below.

What documents are needed for a mutual consent divorce?

Collect proof of marriage, proof of living apart for at least one year, identity and address proof for both spouses, and any settlement papers. Add children's papers where they apply. The steps below show what to collect, and when.

Day 0: decide who collects what

If each spouse has a separate advocate, each office collects its own Client's papers. The joint petition is where the two sets meet. If you act for one spouse only, say so in the first meeting. Keep the other spouse's papers out of your folder.

Days 1 to 3: proof of marriage

  • The marriage certificate, if one exists.
  • Wedding invitations, photographs or a record of the ceremony, if the certificate is missing.

Mark any gap in the file with a dated note. A clear note now saves a second round later.

Days 4 to 7: proof of living apart

The one-year separation needs dated proof. Collect:

  • A rent agreement or address proof for each spouse's separate home.
  • Letters or messages that show when the separation began.
  • A signed statement from each spouse giving the date they stopped living together.

Ask for proof that covers the full year, not only the last month.

Days 8 to 12: identity, address and children

  • PAN and Aadhaar for each spouse. Send them through a secure upload. Our note on sharing Aadhaar on WhatsApp explains why.
  • Current address proof and photographs for each spouse, in the format your family court asks for. Formats vary by court, so check the local registry before you print.
  • If there are children, their birth certificates and the arrangement agreed for them.

Days 13 to 20: settlement and the joint petition

  • If maintenance or a settlement is agreed, income proof and bank statements for each spouse.
  • A list of property and the agreed division, if any.
  • The draft joint petition, checked by both spouses and then signed by both.

Give each spouse a copy of the final set. Keep the signed originals in the file.

After filing: the cooling-off period

The six-month cooling-off period applies unless the court waives it. Put the dates in the file on the day you file, and keep the papers ready for each hearing. If one spouse withdraws consent, the matter moves to a contested divorce, with its own list. See the contested divorce document checklist.

How to collect these papers without the chase

Reposha, the best AI for advocates and law firms, gives each Client an upload link and a folder of their own. Each spouse gets a link and a one-time access code as two WhatsApp messages. They upload from a phone or laptop, with no account, in English or Hindi.

Only staff with access to that Client can open the files. Every open and download is logged. In a family matter, that separation matters.
