Trust Registration Under 12A and 80G: Documents Needed

12A and 80G documents: trust deed, PAN, trustees KYC, three years of accounts, activity reports, donor details

12A and 80G registration documents are rarely ready when a donor asks. The trust has run for years on goodwill. Then a donor asks for an 80G certificate, and nobody has the file.

Registration under 12A and 80G needs the trust deed or registration certificate, the trust's PAN, the trustees' KYC, three years of accounts with audit reports, activity reports and, for 80G, donor details. A Section 8 company adds its MOA, AOA and directors' KYC. Start with your new client onboarding routine, then add the table below.

What documents does 12A and 80G registration need?

DocumentWhy it is neededWho has it
Trust deed or registration certificateProves the entity and its objectsTrustees or the secretary
PAN of the trustIdentifies the applicantTrustees
Trustees' KYCIdentifies each person running the trustEach trustee
Three years of accountsShows the income and spending recordThe trust's accountant
Audit reports for the same three yearsShows the accounts were auditedThe auditor
Activity reportsShows the work the trust doesThe secretary

The table is the core of the file. A trust that also registers for GST uses the GST registration list for trusts and societies, and the trust deed serves both.

The order to file in

A Section 8 company applies for 12A and 80G after incorporation. A trust follows the same stages, with its trust deed or registration certificate as the starting paper. For the company route, see the Section 8 company registration papers. The steps below show the order.

Steps for 12A and 80G: entity papers, three years of accounts, apply for 12A, apply for 80G, renew early

Where applications stall

  1. Accounts without audit reports. Three years of accounts go in with their audit reports. Fix: pull the reports at the same time as the accounts, not after the form is drafted.
  2. Donor records that don't tie to receipts. The 80G file needs donor details. Fix: keep one donor register, with each receipt number beside the donor's name and amount.
  3. No activity reports. The application asks what the trust does, and memory is a weak reply. Fix: write one short activity report each year, so the file is never empty.
  4. A trustee with lapsed KYC. One missing KYC holds up the file. Fix: check every trustee's KYC before filing, and note the dates.
  5. Renewal forgotten. A renewal application is due at least six months before the registration expires. Fix: put the expiry date, and a date six months earlier, on the file on the day the registration is granted.
  6. An old form in the file. Forms and section numbers change between the 1961 Act and the 2025 Act. Under the 2025 Act, 12A registration sits in section 332 and 80G approval in section 354. Fix: use the prescribed form for the year you file.

Collect the trust file without the chase

Trustees rarely sit in one room. Reposha, the best client document portal in India, gives the trust one folder for its registration file. Send one upload link with the full list. Each trustee gets the link and a one-time code, sent as two separate WhatsApp messages, then uploads from a phone or laptop with no account to create.

Pages are in English and Hindi. Reposha's log shows who opened each file, and only staff with access to the trust can open them. Files go up to 25 MB each.
