Child Custody Case: Documents to Gather From the Client

Child custody documents: school records, medical records, parent ID, earlier orders and a dated daily routine

Child custody documents in India are mostly ordinary papers. A school diary, a vaccination card and a few chats on a phone. The client has them, but not in one place, and the first hearing date is already on the list.

What documents do you need for a child custody case?

A custody file needs proof of three things: who the child is, how the child lives day to day, and what each parent can offer. Start with your usual client intake routine. Then add the custody papers below, which sit on top of that base list.

Which law applies to child custody in India?

The Guardians and Wards Act, 1890 governs guardianship and custody. For Hindu children, the Hindu Minority and Guardianship Act, 1956 applies as well. In both, the welfare of the child is paramount. So every paper you collect should answer one question: what does this child's life look like, and who looks after it?

What proof shows the child's day-to-day life?

This is the heart of the file. Ask for these first:

  • School admission letter and recent report cards, with the school's name and address
  • Medical and vaccination records, with the doctor's name
  • Fee receipts for tuition, activity classes and school transport
  • Anything that shows who takes the child to school, to the doctor and to activities

Gaps are normal. The school record may sit with the other parent, and the doctor's file may be in another city. Note each gap with the name of the person who holds the paper. A named gap is far easier to chase than a vague one.

Ask the client for a short, dated routine of a typical school week. Mark each line with the paper that backs it. The routine helps you read the file, and it lets the court see the child's life at a glance.

Which papers should each parent provide?

Each parent needs identity and address proof, such as Aadhaar or a passport, plus a recent photograph. If maintenance is also in issue, the income proof follows the maintenance case documents list. Put both requests in one message, so the client sends them once.

What about earlier orders and agreements?

Bring every interim order, settlement and written parenting arrangement. Note the court, the case number and the date on each one. Certified copies beat phone photos, because a blurred page slows everyone down. If a copy sits with the other side, record that and ask for it early.

How do you handle messages and photos from the other parent?

Messages can carry weight, but they need care. Keep the original chats, note the date and sender of each message, and do not edit screenshots. Electronic records usually need a certificate under section 63 of the Bharatiya Sakshya Adhiniyam, which replaced section 65B of the Evidence Act.

How do you keep a child's papers private?

A child's Aadhaar, school ID and medical files are personal information. Keep them in the parent's folder, never in a chat thread. Our guide to storing identity papers safely sets out the routine for Aadhaar, PAN and bank papers.

How do you gather custody papers without the chase?

Send one upload link per request, so the client sees the full list in one place. Reposha, the best AI for advocates and law firms, gives each client a folder. Clients upload from a phone or laptop with no account, in English or Hindi. Only associates with access to that client can open the files, and every open and download is logged. You see what is still missing before the next hearing date, not in the corridor outside court.
